Force Majeure event is defined as an event due to any cause or causes beyond its control, including but not limited to fire, flood, damage by the elements, or air accident, act of God, strike, lock out or other labour disorder, act of foreign or domestic de jure, or de facto government whether by law, order, legislation, decree, rule, regulations or otherwise, revolution, civil disturbance, breach of the peace, declared or undeclared war, act of interference or action by civil / military authorities or due to any other cause beyond the Parties’ control. Either party may terminate this agreement for anyone or more of such reasons upon written notice to the other party within three (3) working days of such occurrences or receipt of notice of any of the above occurrences. Saturday and Sunday will be treated as non-working days for the purpose of this letter of agreement. HOTEL shall waive the retention amount to only in case of Force Majeure condition / circumstances. Refund, if applicable, will be made in form of a Credit Note valid for 365 days from the date of the event.
Cancellations
• HOTEL shall waive the retention amount to client only in case of Force Majeure condition/circumstances. • ‘Cancellation & no show charges will be applicable in case the number of room decrease below the minimum guarantee • In cases of a date shift, retention charges mentioned above shall apply and same will be forfeited. The initial conference dates shall be deemed as cancelled. In case of cancellation of the event, the following grid will be followed:- PERIOD PERCENTAGE CHARGEABLE OF TOTAL ESTIMATED CHARGES 120 days prior check in:50% of total charges 60 days prior check in:75% of total charges 45 days prior check in:100% of total charges
Terms and Conditions
TERMS & CONDITIONS 1. Food shall be prepared only for the expected number of guests & 10% more than of the guaranteed number of guest. Should the number of persons exceed 10% of the guaranteed number, and the hotel would be would not be responsible for the consistency in the quality of food and services. 2. Any addition beyond the expected number of guests would attract an additional charge of 10% of the rate applicable. 3. As per hotel policy, alcoholic beverages from outside are not permitted to be served in the hotel premises. However, the hotel would be glad to offer you special concessional rates for the same. 4. As per the hotel policy, food items from outside would not be allowed to be served at the venue. 5. Any additional services not mentioned above will be charged as per applicable rates. 6. Audio visuals and will be charged on actual consumption and would not be included in the minimum revenue. 7. Unless otherwise specified, all meals will be on a standard buffet basis. Special menus, sit-down menus, cocktail snacks and all beverages including mineral water, and alcoholic & non-alcoholic beverages will be charged extra as per consumption. 8. Tea & coffee breaks will be served in a pre-function area attached to the hall (if available). 9. We can arrange for special décor setups, theme events and entertainment at an additional cost. 10. Further details are mentioned in Section B of the Terms and Conditions. 11. Guaranteed revenue on excel sheet is valid for same function & venue and cannot be clubbed with any other function revenue. 12. Snacks services as per mentioned time would be continuous and no break timing can be entertained further. Although the timing will be decide by the Signing authority. 13. Guest is allowed to increase the MG prior 15 days of the event on same agreed rate. 14. The number of guests attending the event will have to be accordance with the Government guidelines applicable on the day of event. STIPULATIONS APPLICABLE FOR BANQUET ARRANGEMENTS: 1. Should there be a reduction or increase by 10% or more of the original requirement, the hotel reserves the right to make changes in the banquet rates/hall rentals as deemed appropriate. Any increase in banquet numbers will be accommodated only subject to availability. 2. INR rates mentioned will apply to all guests irrespective of the nationality/resident status. 3. Our proposal for the conference/event/delegation is based on the requirement of banquets (estimated billing from function spaces). In case of any change in these requirements, the offer is liable to be reviewed/withdrawn at the discretion of the hotel. 4. The rates are net, non-commissionable. 5. The hotel reserves the right to cancel the signed contract in the event that Advance/Installment Payments are not received by the hotel on the stipulated dates. 6. Unless otherwise intimated by the organiser and acknowledged by the hotel, any tentative reservation (if made), and quotations as specified in this letter will be held / valid, for a maximum of 48 hrs from the date of issue of this proposal, but subject to the below mentioned cut off date. STIPULATIONS APPLICABLE FOR MEETING ROOM / BANQUET ARRANGEMENTS: 1. Please note Taxes will vary on the requirement as per slab 2. In the event the Minimum Guaranteed number drops below the above mentioned, an additional Hall Rental will be levied to compensate for the shortfall in billing. Taxes will be applicable. 3. In the event an additional Rental Charge is levied in addition to the Per Person rate, this is to comply with the minimum billing required for the said space. 4. Rental Charges are inclusive of only the usage of the space for the prescribed time period 5. All rates will be inclusive of note pads & pencils for the attending delegates and flip chart and white board (one of each per meeting room) 6. All the requirements for the Banquet function, including menu, seating arrangements, floral arrangements, requirement of audio/visual equipment’s should be finalized at least 15 working days prior to the function unless the function itself is booked at a shorter notice. Accurate break-ups of the Vegetarian and Non-vegetarian guests, especially in the case of pre-plated menus should be given. 7. The Banquet Event Order containing details of the function should be signed off at least five days prior to the function by you and the hotel. 8. The hotel’s liability for catering is up to the “Expected Number” of guests, the figure for which should not exceed the “Guaranteed Number” by more than 10%. The hotel will endeavour to cater in case the actual number of guests moves up beyond expected number, but may not be able to provide consistency in quality. The difference between the Expected covers and the Minimum Guarantee should not exceed 20%. If the Actual Covers exceed 10%, the excess would be charged at a premium. 9. Food and beverage items provided by the hotel during a banquet function will be served / consumed at the hotel premises only. No outside food or beverage will be allowed in the hotel. Any left-over food or beverage will not be removed from the premises for consumption outside the hotel premises even if the number of persons actually attending the banquet function were lower than the minimum guaranteed number. 10. Charges for usage of the audio-visual equipment, telephones, laundry, mini-bar, charged facilities of the health club, room service, business centre, smokes and liquor, transportation, sightseeing, spouses program, theme/gala evenings additional food & beverage services including (but not limited to) mineral water, enhanced menus, snacks, etc. and any other facility utilized other than as part of the package will be charged as per actual usage. 11. Liquor will be served only within the timings specified by the State Excise laws. Furthermore alcoholic beverages will not be served on days notified by appropriate authorities as ‘Dry’. 12. The Management will not be liable for any theft, loss or damage to your and your guest’s belongings including guest’s vehicles during the event. 13. You will be liable for any damage caused to hotel property or equipment by you or the client’s guests attending the event or the event management company employed by you. 14. All the material, apparatus and equipment of the event management company will be checked by the hotel security before being brought into the hotel premises. Hotel reserves the right to prohibit the entry of any equipment/apparatus found unsuitable. All equipment will be endorsed by banquet manager and hotel security. 15. All 3rd party vendors contracted by guests are required to comply with the rules & regulations of the hotel It will be your responsibility to convey the said rules and regulations to all your/your contracted event management company’s employees, agents, contractors and sub-contractors. Any breach thereof shall be compensated by you. 16.Client will be responsible for the protection of all hotel property in the case of outside props or equipment is brought into the hotel by you or your affiliates. Any damage to the hotel property, due to disregard of hotel policy in this matter, will be charged to you. 17. The hotel reserves the right of admission and can ask any person/s who is/are not properly attired or who misbehaves, to leave the hotel premises. 18. It is necessary to purchase all alcoholic and non-alcoholic beverages from the hotel during function at venue. 19. Playing of music live or recorded musical performance or recital is not permitted beyond 2200 hrs and 2330 hrs at an outdoor and indoor venue respectively. All music / musical performances will be required to be turned off as per the stipulated timings / local laws.- 65db up to 2200 hrs and 55db after 2200 hrs. 20. As per the Government of India regulations please note that smoking in all Public areas of the hotel including restaurants, bars, banquet halls etc. is prohibited and any violation thereof is a punishable offence.
